Terms of Use

The Service is operated by MyPattern, Inc. ("MyPattern," "we," "us," or "our").

The Service allows users to visit findmypattern.com, join the waitlist for updates, and, upon creating an account, upload personal health data and receive AI-generated personalized health recommendations ("Patterns").

Certain features, including telehealth services, pharmacy services, and supplement purchases, are not yet available and will be introduced in future updates. Third-party lab ordering is available through a laboratory services integration platform that provides access to a network of CLIA-certified laboratories. Telehealth services are available through the laboratory services integration platform by licensed independent healthcare providers and may be offered when laboratory results are critical, abnormal, or otherwise require clinical follow-up. Electronic Health Record (EHR) connectivity is available, which allows you to sync medical records from participating healthcare institutions with your authorization. Your use of these features is subject to additional terms presented at the time you access them.

"Health data" means any information you provide, upload, or sync through the Service that relates to your physical or mental health, including but not limited to: prescription and medical usage, supplement usage, lifestyle information, vitals and biometric data, wearable device data, lab results, doctor appointment history, medical records, and any other health-related information you choose to share. Health data also includes any Patterns or other outputs generated by the AI Recommendation Engine based on your information.

Joining the waitlist or signing up for updates does not guarantee access to any product, feature, or service, and does not create any obligation for MyPattern to provide any product, feature, or service by any particular date or at all.

The Service is intended for users who are at least 18 years of age and where such use does not violate applicable law. By accessing or using the Service, you represent and warrant that you are at least 18 years old and are able to form a binding agreement with MyPattern. If you are under 18, you may not access or use the Service or provide any personal information through it. If we learn that we have collected personal information from anyone under 18, we will promptly delete that information.

To use certain features of the Service, you must create an account. You agree to provide truthful, accurate, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify MyPattern immediately of any unauthorized use of your account.

You may create only one account per person. MyPattern reserves the right to suspend or terminate your account at any time for any reason, including violation of these Terms of Use.

You agree not to:

• use the Service in any unlawful manner;
• interfere with or disrupt the operation of the Service;
• attempt to gain unauthorized access to the Service or related systems;
• use any robot, scraper, crawler, or other automated means to access the Service, except as permitted by standard search engine practices;
• introduce any virus, malware, or other harmful code to the Service; or
• submit false, misleading, or fraudulent information through the Service.

PLEASE READ THIS SECTION CAREFULLY. BY USING THIS SERVICE, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

a. MYPATTERN DOES NOT PROVIDE MEDICAL ADVICE.#

MyPattern does not offer medical advice, diagnoses, medical treatment, or any form of medical opinion through the Service. All Patterns and other content through the Service are generated by artificial intelligence for informational purposes only.

b. PATTERNS ARE AI-GENERATED AND MAY CONTAIN ERRORS.#

Patterns are generated using third-party artificial intelligence models. AI technology can produce inaccurate, incomplete, or misleading outputs. You should not rely on any Pattern as a substitute for professional medical judgment. Always consult a qualified healthcare provider before making decisions about your health.

c. NO DOCTOR-PATIENT RELATIONSHIP.#

Your use of the Service does not create a doctor-patient relationship between you and MyPattern, its employees, contractors, or Medical Advisory Panel members. MyPattern's Medical Advisory Panel and MyPattern team members review AI outputs to train and improve the AI Recommendation Engine and may have access to your health data and user profile for the purpose of validating AI outputs and improving the AI Recommendation Engine.

d. NOT FOR EMERGENCIES.#

The Service is not intended for use in medical emergencies. If you believe you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. Do not rely on the Service for emergency medical assistance.

e. ASSUMPTION OF RISK.#

To the fullest extent permitted by applicable law, you assume all risk associated with your use of the Service and any decisions you make based on Patterns or other content provided through the Service. MyPattern disclaims all liability for any harm arising from your reliance on any Pattern or other content provided through the Service.

a. Consent to Processing.#

By creating an account and uploading health data through the Service, you consent to MyPattern collecting, storing, and processing your health data as described in these Terms of Use and Privacy Policy. This includes transmission of your health data to third-party artificial intelligence model providers for the purpose of generating your Patterns.

b. Medical Advisory Panel.#

MyPattern's Medical Advisory Panel, consisting of independent contractor physicians and naturopaths, reviews AI-generated outputs and may access user profiles and health data for the purpose of validating, training, and improving the AI Recommendation Engine. By using the Service, you acknowledge and consent to this access and use. Panel members do not provide individualized medical advice to you.

c. Data Storage.#

Your health data is stored on secure cloud infrastructure. MyPattern uses administrative, technical, and physical safeguards designed to protect your health data, but no method of storage or transmission is completely secure.

d. Accuracy of Your Data.#

You are solely responsible for the accuracy and completeness of the health data you provide. MyPattern relies on the data you submit to generate Patterns. Inaccurate or incomplete data may result in inaccurate or inappropriate Patterns. MyPattern is not responsible for any Patterns generated based on inaccurate or incomplete data you provide.

e. No Obligation to Act.#

MyPattern is under no obligation to review, verify, or act on any health data you provide. MyPattern does not monitor your health data for emergencies or time-sensitive conditions.

f. Deletion.#

You may request deletion of your health data at any time by contacting us at privacy@findmypattern.com. For more information about deletion, see our Privacy Policy.

g. AI Model Training and Deletion Limitations.#

You acknowledge that your health data may contribute to the training and improvement of MyPattern's AI Recommendation Engine through the Medical Advisory Panel review process. Through this process, the AI models may incorporate generalized learnings that cannot be attributed to or deleted on behalf of any individual user. If you request deletion of your health data, MyPattern will delete your raw health data from its systems, but generalized learnings already incorporated into the AI models cannot be reversed or extracted. These learnings do not contain your identifiable health data.

h. De-Identified Data and AI Development.#

MyPattern may de-identify your health data by removing information that could be used to identify you individually, consistent with applicable law. Data that has been appropriately de-identified and cannot reasonably be linked to you is not subject to the health data restrictions in these Terms of Use or our Privacy Policy.

MyPattern and its affiliates and related entities may use de-identified data to develop, train, test, and improve artificial intelligence models and related technologies, including models used to power or enhance the Service. De-identified data may also be used to generate synthetic data sets for AI research, training, and evaluation. These activities do not expose your identifiable information.

i. Wearable Device Data.#

If you connect a wearable device or fitness tracker through the Service, you authorize the device manufacturer's platform to share your health and activity data with MyPattern. Your use of wearable device integrations is subject to the device manufacturer's own terms and privacy policy. MyPattern is not responsible for the accuracy of data retrieved from wearable devices and provides no warranty regarding data from third-party wearable platforms. MyPattern's use of your wearable data is limited to populating your health profile and generating Patterns within the Service.

If you sign up through the Service or create an account, you agree that MyPattern may use the information you provide to manage the waitlist, manage your account, deliver Patterns, and send you communications about the Service, including product updates and related communications.

You may unsubscribe from marketing emails at any time by using the unsubscribe link in our emails.

If you have provided your mobile phone number and opted in to receive text messages from MyPattern, you may receive recurring automated text messages, including account updates, tracking reminders, and replies to member-initiated support requests (collectively, "SMS Notifications"). Message frequency varies. Msg & data rates may apply. Reply HELP for help or STOP to cancel at any time. Consent to receive text messages is not a condition of creating an account. See Section 9 and our Privacy Policy for more information.

If you contact us by email at hello@findmypattern.com, please be aware that this email address is not a protected health information (PHI)-secured channel. You should not include any PHI in emails sent to this address. Communications sent to this address will be retained by MyPattern.

Our collection and use of personal information is governed by our Privacy Policy.

MyPattern collects your mobile phone number when you create an account and uses it for account verification, optional notifications, and account security as described below.

a. Account Verification.#

When you create an account, MyPattern will send a one-time verification code (OTP) to the mobile number you provide to confirm ownership of that number. This is a single transactional message and is not part of a recurring messaging program. Msg & data rates may apply.

b. Notification SMS.#

During account setup and later in your profile preferences, you may enable SMS notifications by toggling on the SMS Notifications setting. The toggle reads: "Text me about account updates, new insights and tracking reminders." Enabling this setting constitutes your opt-in to receive account notifications from MyPattern at the number associated with your account. Opting in is not required to create an account or access the Service.

c. Supported Message Types.#

SMS Notifications are transactional in nature and include: (i) notifications that account updates are ready to view in the Service; (ii) tracking reminders and pattern updates; and (iii) replies to user-initiated support requests. No marketing or promotional content will be sent via SMS.

d. Two-Factor Authentication.#

You may enable two-factor authentication for your account at any time through your account settings. If enabled, you may choose to receive authentication codes by email or authenticator app.

e. Opt-Out.#

You may opt out of SMS Notifications at any time by replying STOP to any message. After you reply STOP, you will receive one confirmation message: "You have been unsubscribed from MyPattern messages and will receive no more. Reply START to resubscribe." No further messages will be sent unless you opt in again.

f. Help.#

For assistance with SMS Notifications, reply HELP to any message. You will receive: "MyPattern: For help, contact our support team by email at support@findmypattern.com. Msg & data rates may apply."

g. Third-Party SMS.#

Third-party service providers, including laboratory partners, may send you SMS communications in connection with services you request through MyPattern, such as order status updates and appointment reminders. These communications are sent by the applicable third party and are governed by that party's own messaging terms and disclosures, not these SMS Terms. Your consent to these third-party messages is collected at the time you place your order.

h. Privacy of SMS Data.#

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

The Service, including its text, graphics, logos, designs, layout, and other content, is owned by or licensed to MyPattern and is protected by applicable intellectual property laws.

Subject to these Terms of Use, MyPattern grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service solely for its intended purpose.

You may not copy, modify, distribute, sell, republish, or create derivative works from the Service or its content except with MyPattern's prior written consent.

If you provide MyPattern with any feedback, suggestions, ideas, comments, or recommendations regarding the Service or any Patterns ("Feedback"), you agree that MyPattern may freely use, copy, modify, create derivative works from, and otherwise exploit such Feedback for any purpose without any obligations, compensation, or attribution to you. You assign MyPattern all right, title, and interest in and to any Feedback you provide. Nothing in these Terms of Use obligates MyPattern to use any Feedback.

The Service may be made available through, linked from, or otherwise associated with third-party platforms or services. MyPattern is not responsible for third-party platforms, websites, services, or content, and your use of those third-party services is governed by their own terms and policies. MyPattern is also not responsible for the results provided by any laboratory.

Laboratory Services. When you order laboratory tests through the Service, those tests are fulfilled by a third-party laboratory services integration platform and its network of CLIA-certified laboratory partners. MyPattern shares your name, address, and phone number with this platform to fulfill your order. Your phone number is also used by this platform to send you SMS communications about your order, including order status and appointment reminders; your consent to those messages is collected at the time you place your order. Your use of laboratory services is subject to the terms of the laboratory platform and the terms presented to you at the time of ordering. MyPattern is not responsible for the availability, accuracy, or timeliness of laboratory test results.

Telehealth Services. Telehealth services available through the Service are offered in connection with laboratory results that are critical, abnormal, or otherwise require clinical follow-up. Those services will be provided by independent licensed healthcare providers contracted through our laboratory platform. Before purchasing a lab, you will be presented with a Telehealth Consent Form and will be required to acknowledge it. MyPattern does not provide telehealth services and is not responsible for clinical decisions or outcomes.

The Service uses third-party analytics and advertising technologies as described in our Privacy Policy. These third parties may collect information about your visit to the Service in accordance with their own privacy policies. MyPattern is not responsible for the privacy practices of these third parties.

a. Fee Structure.#

The total price displayed at checkout for each laboratory test includes: (a) the laboratory collection and processing fee charged by the performing laboratory partner; (b) where applicable, a physician order and results review service fee charged by the reviewing clinician; and (c) a MyPattern service fee for facilitating access to laboratory services through the Service. Payment processing costs are embedded in the total price and are not charged as a separate line item. b. Cash Pay; No Insurance Billing.#

MyPattern does not accept insurance and no claim will be submitted on your behalf to any insurer, government health program, or third-party payer. All prices reflect direct cash-pay rates. If you have insurance coverage, you may independently seek reimbursement from your insurer, but MyPattern does not facilitate or guarantee insurance reimbursement. If you are a Medicare or Medicaid beneficiary, applicable program rules may affect your ability to pay out of pocket for laboratory services that are covered benefits. MyPattern recommends that you confirm your program's rules before ordering.

c. Geographic Availability.#

MyPattern's laboratory ordering services are not currently available in all states. At this time, MyPattern does not maintain laboratory draw locations in the following states, and you may not schedule a specimen draw in these states through the Service: Arizona, Hawaii, Maine, Michigan, New Jersey, New York, North Dakota, Pennsylvania, Rhode Island, and South Dakota. MyPattern may update this list from time to time and will revise these Terms accordingly. Your eligibility to place a laboratory order is determined by the state in which the specimen draw will occur and not by your state of residence or billing address. Users whose billing address is in one of the states listed above may place orders and schedule specimen draws at laboratory locations in eligible states. MyPattern makes no representation that its fee structure or the laboratory ordering services comply with the laws of your state of residence and expressly disclaims liability arising therefrom.

d. Payment Processing.#

Payments for laboratory services and applicable fees are processed by Stripe, Inc. ("Stripe"), a third-party payment processing platform. When you submit payment information through the Service, your payment card data is transmitted directly to and processed by Stripe pursuant to Stripe's Services Agreement (stripe.com/legal/ssa) and Stripe's Privacy Policy (stripe.com/privacy). MyPattern does not store your full payment card numbers or card security codes. To protect your health information, transaction descriptions submitted to Stripe for payment processing will not identify the specific laboratory tests you have ordered. Your use of the payment processing feature is subject to Stripe's applicable terms and conditions.

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, MyPattern disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

MyPattern does not warrant that the Service will be uninterrupted, secure, error-free, or available at any particular time, or that any information or Patterns delivered through the Service are complete, accurate, or current.

MYPATTERN MAKES NO WARRANTY REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY PATTERN OR OTHER AI-GENERATED CONTENT. ALL PATTERNS ARE PROVIDED "AS IS" AND WITH "ALL FAULTS."

To the fullest extent permitted by applicable law, MyPattern and its officers, directors, employees, contractors, advisors, affiliates, service providers, licensors, and Medical Advisory Panel members (collectively, the "Released Parties") will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or related to your use of or inability to use the Service.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYPATTERN'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS OF USE SHALL NOT EXCEED FIFTY DOLLARS ($50.00 USD).

MyPattern may change, suspend, or discontinue the Service, or any part of it, at any time and without notice.

We may update these Terms of Use from time to time. If we do, we will post the updated version on the Service and update the "Last Updated" date above. By continuing to use the Service after updated Terms of Use are posted, you agree to the revised Terms of Use. If MyPattern introduces features that materially change how health data is collected, used, or shared (including telehealth services, pharmacy services, supplement purchases, or third-party lab ordering), you will be required to review and accept updated Terms of Use and Privacy Policy before accessing those features.

These Terms of Use are governed by the laws of the State of Delaware, without regard to its conflict of laws principles.

Before initiating any legal proceeding, you agree to contact MyPattern at support@findmypattern.com and describe the dispute in reasonable detail. The parties will have thirty (30) days from receipt of such notice to attempt informal resolution. If the dispute is not resolved within that period, either party may pursue their available legal remedies. Nothing in this section limits either party's right to seek emergency injunctive or other equitable relief in a court of competent jurisdiction.

Any dispute arising out of or relating to these Terms of Use or the Service will be brought exclusively in the state or federal courts located in Delaware, and each party submits to the personal jurisdiction of those courts.

If any provision of these Terms of Use is held unenforceable, the remaining provisions will remain in full force and effect.
